Please read these Terms and Conditions ("Terms") carefully before using the Kavach mobile application ("the App"). By installing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
Kavach is a security tool designed to identify and help block fraudulent calls and SMS messages. The App uses a combination of local AI analysis, community-sourced reporting, and automated challenge systems (IVR).
AI & Heuristics: Kavach uses machine learning and pattern matching to detect fraud. You acknowledge that no security system is 100% accurate. Kavach may occasionally misclassify legitimate communication as "Scam" (a false positive) or fail to detect a sophisticated fraud attempt (a false negative).
Informational Purposes: All alerts, "Digital Arrest" warnings, and risk scores provided by the App are for informational purposes only. You are solely responsible for any decisions made based on this information, including any decision to share bank details or transfer money. The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the maximum extent permitted by law.
Crowdsourced Data: A core feature of Kavach is the ability for users to report numbers as scams. You acknowledge that these reports are generated by other users and are not individually verified by Kavach.
Honesty Requirement: You agree to use the reporting feature in good faith. You shall not maliciously report legitimate phone numbers (for example, personal contacts, businesses, or government agencies) as scams.
Reports: Kavach acts as a neutral platform for community feedback and is not responsible for the content of user reports or for any consequences resulting from a number being flagged based on community activity.
Best-Effort Service: The SOS alert feature relies on third-party network connectivity and Firebase Cloud Messaging (FCM). Kavach does not guarantee that SOS alerts will be delivered to your guardians in real time, or at all.
Not a Replacement for Emergency Services: Kavach is not a replacement for official emergency services (such as 112, 100, or 101). In a life-threatening situation, always contact local authorities directly.
Guardian Responsibility: You are responsible for ensuring your designated guardians are aware of their role and that their contact information in the App is accurate.
To the maximum extent permitted by applicable law, the developer of Kavach shall not be liable for any of the following:
Financial Loss: Any money lost to scammers despite the App's warnings, or due to a missed detection.
Communication Loss: Legitimate calls or SMS missed because they were blocked or silenced by the App.
Data Usage: Data charges incurred by the App for syncing the blacklist or sending alerts.
Indirect Damages: Any incidental, special, or consequential damages arising out of your use of, or inability to use, the App.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Indian law, including the Consumer Protection Act, 2019.
Kavach prioritises your privacy by hashing phone numbers (SHA-256) before syncing with the community database. However, you acknowledge that no data transmission over the internet can be guaranteed as 100% secure. Your use of the App is also governed by our Privacy Policy.
We reserve the right to modify, suspend, or discontinue any part of the App (including the AI classification models or community features) at any time. We may also update these Terms from time to time; the "Last updated" date above will reflect any changes, and continued use of the App after changes take effect constitutes acceptance of the revised Terms.
You agree to indemnify and hold harmless the developer of Kavach from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the App, your violation of these Terms, or your malicious reporting of phone numbers.
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Subject to applicable law, the courts at Hyderabad, Telangana, India shall have jurisdiction.
